NEWTOPIA INC. NOTICE OF INFORMATION PRACTICES

At Newtopia, we are committed to keeping your personal information private. This Notice describes the privacy practices of Newtopia. This Notice applies to all of the personal or health records that identify you and the services you receive at Newtopia.

NEWTOPIA

All of our employees, lifestyle experts, advisors, agents, and affiliated partners will adhere to the terms of this Notice. All of these employees, lifestyle experts, advisors, agents, and affiliated partners may share your personal information with each other for reasons of coaching, payment, lifestyle management operations and other uses as set out below.

HOW NEWTOPIA MAY COLLECT, USE AND DISCLOSE YOUR PERSONAL INFORMATION

When you become a client of Newtopia, we may from time to time collect, use and disclose your personal information for the reasons described in this Notice. The following categories describe some of the ways that we may collect, use and disclose your personal information.

Newtopia Assessment. We may collect information you may provide on your Newtopia Assessment, including your contact information, age, gender, occupation, medications and remedies routinely used, treatments or surgical procedures you have received or undergone, and information relating to your weight and weight loss efforts. With your express opt-in consent, we may also collect details about health symptoms you are experiencing or have experienced.

Newtopia Genetics. With your express opt-in consent on your Newtopia Genetics Consent Form, we may collect details about your DNA specifically related to weight and lifestyle management.

Program and Service Information. We may collect information on the weight and lifestyle management programs and services you have enrolled or participated in, other related information regarding your use of our programs and services, and your customer service history, including inquiries, complaints, or records of other customer service we may provide.

Coaching. We may collect, use and disclose your personal information to provide you with lifestyle management services. We may disclose your personal information to registered dietitians, exercise physiologists, clinical psychologists, naturopathic doctors, physicians, geneticists, nurses, or other persons who need that information to take care of you.

Coaching Centre Operations. We may use your personal information for coaching centre operations. This may help us operate Newtopia to maintain and improve client care. For example, we may use your personal information for the purpose of risk management, error management or to improve or maintain the quality of care or to improve or maintain the quality of any related programs or services.

Contacting you. We may collect, use and disclose your personal information to reach you about appointments and other matters. We may contact you by mail, telephone, e-mail, text message or instant message. We may leave voice messages at the telephone number you provide us with, and we may respond to your e-mail or SMS address.

Billing Information. We may collect information including banking information collected for pre-authorized payment purposes, credit card number or other payment-method details, and your billing and payment status and history

Lifestyle-Related Services. We may collect, use and disclose personal information about you to send you mailings about lifestyle-related products and services available at Newtopia.

Charitable Support. We may collect, use and disclose your personal information to contact you in an effort to raise funds to support Newtopia. If we do so, we will also tell you how to cancel these communications.

Research. We may collect, use and disclose your personal information to perform weight and lifestyle management research.

Education. We may collect, use and disclose your personal information for teaching purposes.

Promotions. On occasion, we may use your personal information to provide you with information about other related Newtopia products and services that we believe will be of interest to you, for example based on information provided in your Newtopia Assessment.

Testimonials. With your express consent, Newtopia may collect and use your name, likeness, and any comments you have made or may make, for publicity of any kind, in any media, promotion, or advertisement.

AUTHORIZATION FOR OTHER USES AND DISCLOSURES

We will not collect, use or disclose your personal health information for reasons other than as outlined in this notice without your authorization or as otherwise permitted or required.

YOUR RIGHTS REGARDING YOUR PERSONAL HEALTH INFORMATION

You may, subject to some legal exceptions, access and request a copy of and correct your own personal information, or withdraw your consent for some of the above uses by contacting our Privacy Office at the address below. Your request to inspect or obtain a copy or correct your personal information must be submitted in writing, and be signed and dated. We may charge a reasonable fee for processing your request. Requests for billing records should be sent to our billing department.

COMPLAINTS

If you believe your privacy rights have been violated, you may file a complaint with Newtopia or with the Information and Privacy Commissioner/Ontario. To file a complaint with Newtopia, you must submit your complaint in writing to the Privacy Office at the address provided at the end of this Notice. CHANGES TO THIS NOTICE

Newtopia may change this Notice at any time. Any changes in the Notice could apply to personal information we already have about you, as well as any information we receive in the future. We will post a copy of the current Notice at our facilities and on our Website at www.newtopia.com.
